Introduction

In entering into any transaction using this website you do so on the basis of the following terms and conditions. The terms and conditions of each transaction type are made up of the specific terms relating to the transaction type and the Common Terms.

WILD Encounters, Aqua Camps and other fee-based programmes offered by the Bermuda Zoological Society.

WILD Encounters, Aqua camps and other fee-based programmes purchased on this website are only valid on the selected days. Once the date has been booked, the experience cannot be rescheduled and is non-refundable unless due to exceptional circumstances: illness/injury, pregnancy or bereavement. This is at the Bermuda Zoological Society's discretion.

The reference name can be exchanged providing the Bermuda Zoological Society are given a minimum of seven working days notice.

The Bermuda Zoological Society and the Bermuda Aquarium, Museum and Zoo reserve the right to ask any participant to leave the site should they behave in an inappropriate or unsafe manner. Alcohol must not be consumed prior to the experience, on the day of the contact session, and the Bermuda Zoological Society reserves the right to refuse the participant the right to take part in the experience if they appear to be under the influence of alcohol or drugs.

Whilst every effort will be made to accommodate those with a disability or learning difficulty, due to practicality this cannot always be achieved; please contact the Bermuda Zoological Society for advice. The the Bermuda Zoological Society will endeavour to ensure that all participants have as full an experience as possible.

The Bermuda Zoological Society reserves the right to change any of the dates for any fee-based programmes The Bermuda Zoological Society reserves the right to alter the content of the programme or experience on any given day due to weather or unforeseen challenges, but will ensure that if this is the case then the activity will be replaced with another similar task or the encounter will be offered on another day.

The Bermuda Zoological Society reserves the right to cancel the experience due to unforeseen circumstances.

The Bermuda Zoological Society will give as much notice as possible but this cannot always be guaranteed.

Membership terms

Once a membership has been purchased, the membership is non-refundable unless due to exceptional circumstances. This is at the Bermuda Zoological Society’s discretion.* The Bermuda Zoological Society reserves the right to change these benefits at any time and without prior notice*

  • Standard Membership is based on a standard 12-month contract and starts on the date of purchase unless agreed otherwise by Bermuda Zoological Society.
  • Any card issued with your Membership is for use as directed by the membership level, and is not transferable under any circumstances. Any misuse of the membership card will result in it being confiscated with no refund. The card cannot be given away, sold or transferred. Membership card photocopies are not valid.
  • Bermuda Zoological Society members are entitled to entry to the Bermuda Aquarium, Museum and Zoo only, during normal opening hours.
  • Membership cards are not valid after their expiry date and remain the property of Bermuda Zoological Society at all times.
  • Admission to the BAMZ will not be granted under any circumstances without the production of a valid Membership card. If you do not have your card with you on the day of admission, the current full admission charge must be paid which is not refundable.
  • A membership pass may not be valid for entry on certain special events in the zoo calendar (e.g. ZooBoo) and this will be advertised as such. There will be an additional fee payable for member entry to such events.
  • The Membership card is not a credit card, charge card or cheque guarantee card.
  • An adult must accompany children 14 years old or younger.
  • An administration charge of $5 will be made for lost or replacement Membership cards should you require one. Please call the Membership team prior to your visit so we can take payment and provide you with a temporary access pass.
  • We reserve the right to refuse entry and/or cancel the Membership without refund. In particular if the card holder, or anyone accessing our facilities by virtue of a Membership, behaves in a threatening or abusive way to our staff, contractors or the animal collection, or breaches the terms and conditions relating to access to our facilities membership will be cancelled.
  • The Bermuda Zoological Society has the right to reject applications for membership or renewal
  • All events are subject to availability. BZS Membership does not guarantee availability to BZS events – applications are to be made on an event by event basis.
  • Bermuda Zoological Society’s membership benefits and prices may be subject to change at any time. No refunds can be made.
  • Special Offers – Unless otherwise advised, special offers including joining offers are only available once to each Bermuda Zoological Society member. Each offer will also be subject to additional Terms and Conditions.
  • In the event that a payment is rejected by any bank or credit card company then the membership will be suspended until valid payment of the membership fee (and at the Bermuda Zoological Society’s discretion, payment of any additional costs incurred by Bermuda Zoological Society because of the rejection of the payment) is received by Bermuda Zoological Society. If valid payment is not received then membership will be terminated. Any such termination may be back dated to the date when the rejected payment fell due.
  • The Bermuda Aquarium, Museum and Zoo reserves the right to close or remove some exhibits or areas within the zoos partly, entirely or at certain times of the year for various reasons including, but not limited to, special events and refurbishment.
  • Membership cannot be cancelled during a period which has already been paid for. Membership will automatically terminate at the end of the period you have paid for if payment is not received for the next period.
  • Standard Bermuda Zoological Society terms and conditions apply to all members.
  • 10% discount in the gift shops cannot be used in conjunction with any other offer.
  • This agreement does not affect your statutory rights

 

BZS Gift shop terms

In purchasing items from the online BZS shop not covered by other terms you are entering into an agreement with The  Bermuda Zoological Society. Any order made will be subject to these specific BZS shop terms that incorporate the "Common Terms" applicable to all transactions.

Your Information

Please ensure that when making an order the information you provide is correct and complete. If you wish to make any changes to the information you have provided then please inform the Bermuda Zoological Society of these immediately. However the Bermuda Zoological Society reserves the right not to act on any requested changes unless it would be unreasonable not to act.

Your Order

When you place an order the cost of items and delivery charges, and estimated time scales for delivery, will be specified in the order acknowledgment email that the Bermuda Zoological Society will send to you. The Bermuda Zoological Society will try and ensure that the prices and charges listed at the time of order are accurate, but the Bermuda Zoological Society cannot accept any liability if the information displayed is incorrect. In the event that an error is made you will be informed by email (sent to the email address you have given us) of the correct price or charge within a reasonable time of the Bermuda Zoological Society becoming aware of the error and the Bermuda Zoological Society will ask you whether you wish to continue with your order on the basis of the correct information. If the Bermuda Zoological Society has not received confirmation from you within a reasonable period of time (in response to the Bermuda Zoological Society’s email notification of the error) that you wish to proceed, the order will be cancelled.

Payment

When you place an order through this website, this will be an offer by you to purchase the BZS shop items displayed in your shopping basket that Bermuda Zoological Society advertised. The Bermuda Zoological Society will then send you an acknowledgement email listing the items you have ordered. Payment will be taken from your payment card when your order is completed successfully online. Acceptance of your order and the completion of our contract for the sale of the BZS shop items will take place on the dispatch to you of the items ordered. Ownership of ordered items will pass to you on dispatch.

Dispatch to You

All items are supplied subject to availability and may become unavailable at any time. If the Bermuda Zoological Society is unable to supply the item within 30 days of your order the Bermuda Zoological Society will send an email to your contact email address (as supplied by you) to inform you that this is the case.
The Bermuda Zoological Society will make every effort to dispatch items ordered within 28 working days. Delays will occasionally be inevitable due to unforeseen circumstances such as the unavailability of specific items or factors outside the Bermuda Zoological Society’s control, for example but not limited to postal problems or industrial action. The Bermuda Zoological Society will not be liable for any delay or failure to dispatch items within the estimated timescale.

Delivery

Items ordered will usually be delivered by the Bermuda Post Service and The Bermuda Zoological Society cannot be held liable for any delivery delays following dispatch. In the event of delayed delivery please wait for a period of at least 28 days from the date of dispatch of your order before contacting the Bermuda Zoological Society.
All prices listed include delivery charges, which will be shown in your email notification from the Bermuda Zoological Society.
The Bermuda Zoological Society recommends that you print out and retain your confirmation of dispatch e-mail in case you want to contact us about your order or return items after delivery.

Defective Goods

The Bermuda Zoological Society will always accept return of and offer a refund (including original postage and packing costs) for defective goods returned within 14 (fourteen) days of delivery, as long as the item is returned in its original packaging together with a copy of your confirmation of dispatch e-mail. On return please provide a brief description of the fault.

Non Defective Goods Returns and Order Cancellation

Non defective goods may be returned for any reason to Bermuda Zoological Society’s shop within 7 (seven) days of delivery for a full  refund, not including the price of packaging and mailing the goods. Within a reasonable period of receipt of such returned items the Bermuda Zoological Society will refund to your payment card the items cost. Please note that this does not include the right to return perishable items such as food and sweets, periodicals, personalised items, entrance tickets, audio/video recordings or software that you have unsealed and items such as earrings and cosmetics.

Common terms

In these terms "Bermuda Zoological Society" refers to the organisation relevant to your transaction as specified in the specific terms relating to each transaction type (the "Specific Terms"). The word "Terms" refers to the Specific Terms together with these Common Terms.

Amendments to the Terms

The Bermuda Zoological Society reserves the right to make changes to its website, policies, and the Terms at any time. You will be subject to the policies and Terms in force at the time that you use the website and or you enter into any transaction with the Bermuda Zoological Society, unless any change to those policies or these Terms is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these Terms are deemed invalid, void, or for any reason unenforceable, that term will be deemed severable and will not affect the validity and enforceability of any remaining term and the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

Events beyond Bermuda Zoological Society’s reasonable control

The Bermuda Zoological Society will not be held responsible for any delay or failure to comply with its obligations under these Terms if the delay or failure arises from any cause which is beyond its reasonable control. This term does not affect your statutory rights.

Waiver

If you breach these Terms and the Bermuda Zoological Society takes no action, the Bermuda Zoological Society will still be entitled to use its rights and remedies in any other situation where you breach these Terms.

Warranty as to Age and Residential Status

You warrant that you are at least 18 years of age and possess the legal authority to enter into any transaction through this website (including instructing us to collect any payments from a payment card or billing account) and to use this website in accordance with the Terms. You agree to be financially responsible for all transactions you undertake through your use of this website (as well as for use of your account by others).

Limitation of Liability

Other than liability for death or personal injury resulting from the Bermuda Zoological Society negligence, the Bermuda Zoological Society, its employees and or agents shall not be liable for any loss or damage, direct or indirect, howsoever arising out of or in connection with the Bermuda Zoological Society’s relationship with you to the extent permitted by law.

In the event that the above exclusion of liability is not effective, the Bermuda Zoological Society’s maximum aggregate liability (save in respect of death or personal injury resulting from the Bermuda Zoological Society negligence) shall be the amount paid by the claimant to the Bermuda Zoological Society in respect of the transaction out of which the claim against the Bermuda Zoological Society arose.

Entire Agreement

This agreement constitutes the entire agreement between you and the Bermuda Zoological Society in respect of the relevant transaction and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and the Bermuda Zoological Society with respect to the transaction. A printed version of the Terms and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to the Terms to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

Law

These Terms are governed by and shall be construed in accordance with Bermuda Law, and any claim brought under the Terms shall be subject to the exclusive jurisdiction of the Bermuda Courts.
